Payemoji Acceptable Usage Policy

Payemoji, as a SaaS (Software as a Service) platform, offers businesses with the tools and technologies to set up an online presence and sell products and services. Our business mission holds an open exchange of products and services as a cornerstone for promoting eCommerce. However, there are some types of businesses that we do not allow on our platform.
This
Acceptable Usage Policy (“AUP”) lists out the businesses prohibited to
be carried out through the Payemoji platform.
Definitions: The definitions for all are as below:
“Materials” means any photo, image, video, graphic, written content, audio file, code, information, data, or other content uploaded, collected, generated, stored, displayed, distributed, transmitted, or exhibited on or in connection with your Account.
Capitalized terms are defined in the last section of the policy.
1. The following activities are prohibited for commerce through the Payemoji platform:
1.1. Child exploitation: You may not offer goods or services, or post or upload materials that exploit or abuse children, including but not limited to images or depictions of child abuse or sexual abuse, or that present children in a sexual manner.
1.2. Illegal Products or Services: You may not offer or transact in the operations or exchange of illegal products or services.
1.3. Illegal activities: You may not offer goods or services, or post or upload Materials, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business.
1.4. Harassment, bullying, defamation and threats: You may not offer goods or services, or post or upload Materials, that harass, bully, defame or threaten a specific individual.
1.5. Hateful or Discriminatory content: You may not use the Services to promote or condone hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status or other forms of discriminatory intolerance. You may not use the Services to promote or support organizations, platforms or people that: (i) promote or condone such hate; or (ii) threaten or condone violence to further a cause.
1.6. Malicious and deceptive practices: You may not use the Services to transmit malware or host phishing pages. You may not perform activities or upload or distribute Materials that harm or disrupt the operation of the Services or other infrastructure of Payemoji or others, including Payemoji’s third party providers. You may not use the Services for deceptive commercial practices or any other illegal or deceptive activities.
1.7. Personal, confidential, and protected health information: You may not post or upload any Materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent. You may not use the Services to collect, store, or process any protected health information subject to the Health Insurance Portability and Accountability Act (“HIPAA”), any applicable health privacy regulation or any other applicable law governing the processing, use, or disclosure of protected health information.
1.8. Restricted Items: You may not offer goods or services that are, or appear to be, Restricted Items as defined below in clause 1.12.
1.9. Self-harm: You may not offer goods or services, or post or upload Materials, that promote self-harm.
1.10. Spam: You may not use the Services to transmit unsolicited commercial electronic messages.
1.11. Terrorist organizations: You may not offer goods or services, or post or upload Materials, that imply or promote support or funding of, or membership in, a terrorist organization.
1.12. Additionally, the following items constitute Restricted Items and you may not offer or transact in the items listed below along with some examples of what is allowed and what is restricted:
1.12.1. Drugs, whether prescription, recreational, or otherwise: You may not transact in the sale of illegal, prescription, or recreational drugs. Manufacturers and healthcare services who do not engage in direct sale are allowed.
Examples:
Drugs, including marijuana and marijuana products
Drug paraphernalia, including pipes and bongs
Prescription drugs
1.12.2. Tobacco items and related paraphernalia: You may not transact in the sale of tobacco products or tobacco paraphernalia.
Examples:
Apparel featuring a tobacco brand logo
Cigarettes, cigars, and chewing tobacco
Tobacco pipes and paraphernalia
Tobacco rolling machines
Hookahs
Bongs
Rolling papers
Electronic cigarettes (E-cigarettes) or tobacco devices
1.12.3. Alcohol: You may not transact in the sale of alcohol.
Examples:
Books or DVDs about alcohol
Alcohol-related items, including glasses, coolers, and wine bottle holders
Alcoholic beverages
Kits for producing alcohol
1.12.4. Unsafe ingestible supplements: You may not transact in the sale of unsafe ingestible supplements, as determined by WhatsApp in its sole discretion.
Examples:
Anabolic steroids
Chitosan
Comfrey
Dehydroepiandrosterone
Ephedra
Human growth hormones
1.12.5. Weapons, ammunition, or explosives: You may not transact in the sale or use of weapons, ammunition, or explosives.
Examples:
Promoting safety training or licenses for legal weapons
Firearms and firearm parts
Paintball guns
BB Guns
Fireworks
Pepper spray
Tasers
Gun ranges
Gun shows
1.12.6. Animals: You may not transact in the sale of any animals.
Examples:
Animal cages
Products for animals (toys, collars, etc.)
Veterinary services
Grooming services
Boarding services
Pet adoption services
Live animals
Livestock
Prohibited animal parts, including but not limited to bone, teeth, horn, ivory, taxidermy, organs, external limbs, secretions, or carcasses
Any product or part, including but not limited to leather, skin, hide, fur, wool, or hair from any dogs, cats, and endangered or threatened animals
1.12.7. Adult products or services: Policy: You may not transact in the sale or use of adult products or services.
Examples:
Products promoting family planning and contraception, which focus on the contraceptive features of the product, and not on sexual pleasure or sexual enhancement
Sex toys
Videos or live shows for adult entertainment
Sexual enhancement products
Sexually suggestive services
1.12.8. Body parts and fluids: You may not transact in the sale of human body parts or fluids.
Examples:
Blood donation centers
Blood
Hair extensions and wigs
Urine
Body parts
Organs
Human tissue
Teeth
1.12.9. Medical and healthcare products: You may not transact in certain healthcare products, including medical devices, and smoking cessation products containing nicotine. Manufacturers and healthcare services who do not engage in direct sale are allowed.
Examples: Medical Devices
Lifestyle and fitness accessories
Contact lenses
Bandages and braces for physical injuries
Thermometers
Testing kits for medical conditions or diseases
Breast pumps
First-aid kits
Examples: Smoking Cessation Products
Nicotine patches
Nicotine gum
1.12.10. Items or products with overtly sexualized positioning: You may not position products or services in a sexually suggestive manner.
Examples:
Implied nudity
Implied sexual acts
Zoomed-in sexual images
1.12.11. Real money gambling services: You may not transact in or facilitate gambling, games of skill, or lotteries, including online casinos, sports books, bingo, or poker if it costs money.
1.12.12. Dating services: You may not transact in or facilitate online dating services.
1.12.13. Products or items that facilitate or encourage unauthorized access to digital media: You may not transact in the sale of devices that facilitate or encourage streaming digital content in an unauthorized manner or interfering with the functionality of electronic devices.
Examples:
Add-on equipment for streaming devices such as keyboards and remotes
Sale of streaming devices loaded with software that facilitates unauthorized access to content
Jailbroken or loaded devices
Jamming or descrambling devices
Wiretapping devices
1.12.14. Digital and subscription services, including links to or processing of any subscription sales, renewals, or upgrades: You may not transact in the sale, including renewals and upgrades, etc., of digital content, digital subscriptions, or digital accounts.
Examples:
Authentic audio or video CDs, DVDs, and Blu Ray
Digital devices, including Smartphones, video game consoles, and TVs
Downloadable content, including PDFs, music, games, movies, etc.
Digital accounts, including games accounts
Digital subscriptions and internet streaming services, including TV, Mobile, etc.
Digital coupons
1.12.15. Business models, goods, items, or services that we determine may be or are fraudulent, misleading, offensive, or deceptive, or may be or are exploitative, inappropriate, or exert undue pressure on targeted groups: You may not transact in deceptive, false, misleading, or offensive offers or products.
Examples:
Multilevel marketing
Penny auctions
ICOs and binary options
Payday loans, paycheck advances, P2P lending, debt collection, and bail bonds
Diet, weight loss, or other health related products that imply or attempt to generate negative self-perception
1.12.16. Real, virtual, or fake currency: You may not transact in the sale of real, virtual, or fake currency.
Examples:
Real money (cash or cash equivalent instruments and coins)
Replica or prop money
Digital or cryptocurrency
Active bank credit or debit cards
Store credit cards or coupons
Pre-paid credit or debit cards
Checks or checkbooks
Equipment to create counterfeit currency or financial instruments
1.12.17. Third-Party Infringement: Transactions may not contain content that infringes upon or violates the intellectual property rights of any third party, including copyright or trademark. This includes, but is not limited to, the sale of counterfeit products, such as goods that copy the trademark (name or logo) and/or distinctive features of another company’s products to imitate a genuine product.
Examples:
Counterfeits, knockoffs, or replicas of branded goods, or posts offering goods that are likely to confuse consumers about the source, sponsorship or affiliation of those goods.
Unauthorized or pirated copies of copyrighted works, such as videos, movies, TV shows and broadcasts, video games, CDs or other musical works, books, etc.
2. Definitions: The definitions for all the are as below:
2.1. “Materials” means any photo, image, video, graphic, written content, audio file, code, information, data or other content uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited on or in connection with your Account.
2.2. “Services” has the meaning set out in the Payemoji Terms of Services.
3. We may, at any time and without notice, remove any Materials, and suspend or terminate your Account or your access to the Services if you engage in activities that violate the letter or spirit of this AUP, including activities outside of your use of the Services.
4. Payemoji has the right, but not the obligation, to monitor or investigate any Materials and your use of the Services at any time for compliance with this AUP and the Payemoji Terms of Service, or any other agreement between you and Payemoji governing your use of the Services (collectively, the “Terms”). Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken, or not taken, with respect to enforcing this AUP will be at our sole discretion.
5. Payemoji may modify this AUP, including the list of Restricted Items, at any time by posting a revised version at https://www.Payemoji.com/legal/AUP. By continuing to use the Services or access your Account after a revised version of the AUP has been posted, you agree to comply with the latest version of the AUP. In the event of a conflict between the AUP and the Terms, this AUP will take precedence, but only to the extent required to resolve such conflict. Capitalized terms used but not defined in this AUP shall have the meanings set forth in the Terms.
